What Happened
Accounting Violations: The Securities and Futures Commission (SFC) found that Kumyang violated accounting standards by recording fictitious sales through fraudulent tax invoices. The company also overstated its equity by improperly accounting for its Mongolian subsidiary as a consolidated entity despite shared control.
Regulatory Sanctions: In response to these findings, the SFC imposed a three-year mandatory auditor designation and levied significant fines against the company and its executives. The commission also recommended the dismissal of the CEO and other key personnel, while referring the case to the prosecution for further investigation.
Company's Response: Kumyang expressed strong dissatisfaction with the ruling, labeling the measures as excessive and unfair. The company announced its intention to file an administrative lawsuit to challenge the decision, asserting that the authorities failed to properly consider its explanations.
Listing Status: Kumyang is currently facing delisting proceedings following a disclaimer of opinion from its external auditor. Although the delisting process is temporarily suspended due to a court injunction filed by the company, this latest regulatory blow adds significant uncertainty to its future as a publicly traded entity.
