South Korea's Financial Supervisory Service reports a surge in suspected illegal short selling cases, with 94 instances identified since the launch of the NSDS.

Rise in Illegal Short Selling Reports: The number of suspected illegal short selling cases reported to the Financial Supervisory Service (FSS) has increased significantly over the past few years. Reports rose from just two in 2020 to 77 last year, with 42 cases already identified through July of this year.

Impact of the NSDS: The implementation of the Naked Short Selling Detection System (NSDS) in March 2023 has been instrumental in identifying these cases. By conducting full-scale monitoring of short selling patterns among major institutional investors, the system has significantly improved detection capabilities.

Market Dynamics: Analysts suggest that broader market trends, including increased volatility and a rise in total return swap (TRS) contracts for hedging, have contributed to the higher volume of short selling. This uptick in activity has naturally led to a higher frequency of flagged transactions requiring further investigation.

Call for Enhanced Enforcement: Lawmaker Park Sung-hoon has urged regulators to go beyond mere monitoring by accelerating investigations, sanctions, and profit clawbacks. He emphasized that restoring market confidence requires a robust and swift follow-up process for all detected irregularities.
